Charge : Careless Driving Result : Client was involved in a fatal crash and was subsequently charged with Careless Driving. On the morning of Trial, the State agreed to allow the charge to be sentenced as a Petty Misdemeanor, a non-criminal offense.

Charge : 4th Degree DWI and Possession of Marijuana in a Motor Vehicle Result : Client, who had a prior offense for underage drinking and driving, was charged with a Fourth Degree DWI. The State agreed to amend the charge to Careless Driving and dismissed all other counts.

Charge : Prohibited Person in Possession of Firearm Result : Client, who had been previously convicted of a Crime of Violence, was charged with being in possession of a firearm. If convicted, this charge carries a mandatory minimum penalty of 60-months in prison. After more than a year of litigation the State dismissed the charge at Trial.

Charge : DWI Result : Client was charged with 4th Degree Driving While Impaired in St. Paul, MN. Following a contested evidentiary hearing, the district court determined that law enforcement did not have a reasonable, articulable suspicion of unlawful conduct on the part of our client. Therefore, the arrest violated his constitutional right to be free from warrantless searches and seizures and any evidence obtained as a result of the arrest was suppressed. Charge : Careless Driving Result : Client was charged with Careless Driving stemming from a traffic accident that occurred in St. Paul, MN. Client entered a Not Guilty plea and put the State to its burden of proof. At Trial, the State was forced to dismiss the charges because it determined that it did not have enough evidence to obtain a Guilty verdict beyond a reasonable doubt.

Charge : 3rd Degree DWI (Gross Misdemeanor) Result : Despite the fact that this was Client’s 2nd DWI charge within 10-years which carries a mandatory minimum penalty of at least 30-days in jail, Attorney Kirk Anderson was able to successfully negotiate for the charge to be reduced to a 4th Degree DWI (Misdemeanor), and thus avoiding the mandatory minimum sentence.

Garcia-Mendoza v. 2003 Chevy Tahoe, et al.

Charge : The police attempted to take client’s vehicle and money after they discovered narcotics during the search of his vehicle. The district court found that the search violated client’s right against unreasonable searches and seizures, but awarded the vehicle to the State anyways for other reasons. The Minnesota Court of Appeals refused to return the vehicle to client because it found that the Exclusionary Rule does not apply to civil forfeitures. Result : The Minnesota Supreme Court reversed the Minnesota Court of Appeals and specifically held that the Exclusionary Rule is applicable to civil forfeitures in the State of Minnesota. Charge : Client was convicted of three (3) counts of criminal sexual conduct in the First Degree in Kandiyohi County District Court. Result : The Minnesota Court of Appeals found determined that Client was entitled to a new trial because the District Court allowed hearsay evidence to be introduced at the trial, and that evidence prejudiced Client’s right to a fair trial. The Court of Appeals reversed the convictions and remanded to the District Court for a new trial.
